A lively discussion of ethical dilemmas for attorneys, judges, and social workers practicing in child welfare cases.

 

Abstract: 

Do agency attorneys ever violate the duty of competence?  Do children's attorneys or social workers ever violate the duty of confidentiality or privilege?  And do judicial officers ever fail to disclose conflicts?  They do, and more.  Drawing on such resources as the American Bar Association's (ABA) standards and model rules for lawyers and judicial officers, and the National Association of Social Worker's (NASW) Code of Ethics, NACC certified Child Welfare Law Specialist Gary Seiser, will point out differences between judicial, attorney, and social work ethics in child welfare cases, identify and discuss common ethical dilemmas that arise in child welfare proceedings, and will address the one ethical danger common to all professions working in child welfare.
